1. About These Terms
These Terms and Conditions ("Terms") govern your use of the Eliteconsultes website at eliteconsultes.com and any advisory services you engage us to provide. By submitting an enquiry or entering into an engagement with us, you agree to be bound by these Terms. Where there is a separately signed engagement letter, the terms of that letter take precedence over these Terms in the event of conflict.

2. Our Services
Eliteconsultes provides advisory services to non-profit and community organisations, with a focus on helping teams understand where AI-assisted drafting can ease operational tasks such as grant reporting, donor correspondence, and volunteer communications. Our current service offerings are:
- Operations Listening Visit (RM 970) — a structured observation and written brief covering potential AI drafting applications within your organisation's existing workflows
- Reporting & Correspondence Pilot (RM 1,180) — a supervised four-week deployment of an AI drafting assist for grant reports, donor letters, and volunteer communications, including bilingual training and templates
- Quarterly Stewardship (RM 4,560 per year) — an ongoing advisory engagement including quarterly reviews, output sampling, donor data auditing, and compliance briefs for your board
Service scopes, deliverables, and timelines are set out in individual engagement letters agreed between us prior to work commencing. We reserve the right to update our service offerings and pricing; any such changes will not affect engagements already confirmed in writing.
3. What We Do Not Do
It is important that you understand the limits of our advisory role:
- We do not select, rank, or score your beneficiaries or grant recipients. Those decisions remain entirely with your organisation and its governance structures.
- We do not score, profile, or make assessments of your donors. Any drafting assistance is limited to correspondence, not donor evaluation.
- We do not replace the judgement of your staff, volunteers, or board members. All AI-assisted drafts require review and approval by your team before use.
- We do not provide legal, tax, or financial advice. References to ROS, LHDN, PDPA, or other regulatory frameworks are for general context only and should not be taken as professional legal or compliance advice.
4. Engagement and Payment
An engagement begins when both parties have agreed the scope in writing (typically by email or a signed engagement letter) and we have confirmed availability. Payment terms are as follows:
- For the Operations Listening Visit and the Reporting & Correspondence Pilot, a 50% deposit is required before work commences, with the balance due upon delivery of the written brief or at the end of the supervised period, respectively.
- For Quarterly Stewardship, fees are invoiced quarterly in advance.
- Payment is due within 14 days of invoice date. Late payments may be subject to a monthly interest charge of 1.5% on the outstanding balance.
- All prices are quoted in Malaysian Ringgit (RM) and are exclusive of any applicable taxes unless stated otherwise.
5. Cancellation and Rescheduling
If you need to cancel or reschedule a confirmed engagement:
- Cancellations made 10 or more working days before a scheduled visit or commencement date will receive a full refund of any deposit paid.
- Cancellations made fewer than 10 working days before commencement will forfeit the deposit. We will make reasonable efforts to reschedule at no additional cost where circumstances allow.
- If Eliteconsultes needs to cancel or reschedule, we will notify you as early as practicable and offer a full refund or alternative dates at your preference.
6. Confidentiality
We treat all information shared with us during an engagement as confidential. We will not disclose details of your organisation's operations, donor data, financial position, or internal documents to any third party without your written consent, except where required by Malaysian law. This obligation continues after the engagement ends.
In return, we ask that you treat any proprietary methods, templates, and written materials we provide as confidential and not share them with third parties without our consent.
7. Intellectual Property
Written briefs, templates, and training materials produced specifically for your organisation during an engagement become yours upon full payment. General methodologies, frameworks, and background materials developed by Eliteconsultes remain our intellectual property. You may use deliverables internally for the purposes for which they were created; redistribution or commercial resale is not permitted without our prior written agreement.
8. Data Protection
We handle personal data in accordance with Malaysia's Personal Data Protection Act 2010 (PDPA) and our Privacy Policy. If an engagement requires us to process personal data on your organisation's behalf (for example, reviewing donor correspondence), we will discuss and agree appropriate data handling arrangements before commencing that work.
9. Limitation of Liability
Our advisory services are provided in good faith based on the information you share with us and our professional judgement at the time of the engagement. To the extent permitted by Malaysian law:
- Eliteconsultes's liability for any claim arising from an engagement is limited to the fees paid for that specific engagement.
- We are not liable for indirect, consequential, or incidental losses, including loss of funding, loss of donor relationships, or regulatory penalties, unless caused by our gross negligence or wilful misconduct.
- We are not responsible for the performance of third-party tools (such as Google Workspace or Microsoft 365) that your team uses independently.
10. Website Use
The content on our website is provided for general information purposes. We take reasonable care to keep it accurate and current, but we make no warranties as to its completeness or suitability for your specific circumstances. You may use the website for lawful purposes only. You must not use it in any way that disrupts our services or infrastructure, or that involves transmitting harmful or unlawful content.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or from an engagement with us will be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Changes to These Terms
We may update these Terms from time to time. The effective date shown at the top of this page will reflect the date of the most recent revision. Continued use of our website or services after an update constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
